BREAKING NEWS: Stop Parading Yourself As Abia APC Chairman-Elect, Court Sternly Warns Enyinnaya Harbour
An Abia State High Court sitting in Ukwa, Aba has ordered Mr. Enyinnaya Harbour to stop parading himself at the chairman-elect of All Progressives Congress in Abia State pending the hearing and determinationof the motion on notice.
This follows a suit with No. HUK/50/2021, filed by Davies Jumbo, Eng.John Nnan, Hon Ikedi Ezekwesiri and Hon. Nnann Ngwu.
The court presided over by Hon. Justice C. Ahuchaogu in the restraining order on Wednesday also barred the All Progressives Congress, APC and its caretaker committee chairman, Mai Mala Buni from receiving, accepting and/or acting on the purported list of successtul candidates for the All Progressives Congress, State Congress in Abia State, from Rt. Hon. Mukter Bajeh.
An order of interim injunction is also granted for both parties to stay all action(s) connected/related to the Subject matter of this suit and to maintain status quo, pending the hearing and determination of the motion on notice.
The order further recognizes Donatus Nwankpa as the caretaker committee chairman of APC in Abia.
The court further granted a leave to the Claimants/Applicants to serve the APC, its interim chairman, Mai Mala Buni, Secretary Caretaker committee, John James Akpanudoedehe at their off, APC Secretariat No. 40 Blantyre Street, Wuse, Abuja, through a reputable courier company.
Enyinnaya Harbour is to be served through any staff at his School May Fair Academy, No. 52 Marcuarly Street, Umuahia.
Order Is also granted abridging the time for the parties to respond to the motion on notice to wit: the Respondents to respond within 5 days upon service of the processes, and the Applicants to reply on point of law within 2 days upon the service of the Reply and 15 days from the date of service of the Statement of Claim, to file Statement of Defence and 5 days for the Claimant to file reply (if any).
